We are thrilled to share that our Managing Director, Kelvin Foo, had another opportunity to speak with CNA 938 Live yesterday evening on a timely topic: The proposed removal of the mandatory minimum sentence and disqualification period for first-time dangerous or careless driving offenders.
During the interview, Kelvin shared thoughtful insights:
a. Are the adjusted charges adequate to achieve the original intention of allowing greater discretion on sentencing and the prosecution flexibility to press charges of the offence.
Hence, the criteria on adjusted/ reduced charges are crucial. To achieve the key purpose, it is important to monitor this over a feasible duration. The monitoring gives more evidence to whether the adjusted charges are adequate.
b. Rationale of the amendments: The amendments to the law will "recalibrate the balance" between deterrence and proportionality for road traffic offences, said the Ministry of Home Affairs (MHA) in a press release. This gives the courts greater discretion on sentencing and the prosecution flexibility to press charges depending on the circumstances of the offence, the ministry added.
c. The proposed Bill will also empower immigration officers to administer breathalyser tests at border checkpoints. Kelvin also expressed his consensus to this move which will move Singapore to even a safer country.
